I want to buy a cheap but cheerful phone with good size screen for Internet access... OS isn't really an issue, Window Mobile would be practical, but Android sounds interesting. Absolutely nothing Apple related as I need bluetooth functionality.

One phone that has got my interest is the Toshiba TG01, but I've also heard stories of it overheating and other issues that meant Orange dropped it from their catalogue.

Hmm... dunno what to go for...

The HTC Desire HD and replacement for the HD2 are either out now in the case of the Desire HD or next month in the case of the HD2's replacement.
This should mean people getting rid of the older phones, both of which are spot on...

A bit off topic but just brought my Daughter a new Blackberry on a 24 month contract with 300 mins - unlimited texts - Unlimited web and blackberry services for £20 per month. signed contact 3 weeks ago and just got my first bill for £25 so contacted (Tesco ) as I purchased it through them in their phone shop and was told it was a mistake by T Mobile and need to speak to them. So I did and they have informed me that Tesco should not have given me Both Unlimited Text and Unlimited Web its one of the other. to have both it will be £5 extra per month. As I have said to Tesco's I have a signed contract agreement which clearly states what I get for free and what I pay for. Tesco's are talking to T mobile as I type but don't give me much hope as Manager said it should not have been sold as this. I said not my fault I have a 2 year contract. Where do I stand ?
(shouldn't put 17 year old's that don't know what there are selling on shop floor- Its all computerised for gods sake)

So Claw DONT GO TO TESCO AS THEY AINT GOT A CLUE

Stick to your guns Mega, if you have the circumstances to go through the hassle. (It can be stressful) Just imagine it the other way around... these companies cry consistency when it comes to contracts, as in 'they don't allow anyone else to break contracts so why should they allow you to break them' mentality. Do you think they would allow you to cancel a contract once signed?

If you would like to proceed, get some legal advice immediately just to make sure of your own position and their terms of the contract, and then tell them to sort it out between them as you're only signed up to pay such and such amount.

I work for O2 Home Broadband and we get things like this all the time, We generally say if they were sold a deal or offered a refund/discount, then they get the deal as long as there is a contract or note in the account to say that it is what they should be getting. If your contract says unlimited Text/web and 300 mins they really have to honour that.

That looks nice, and I like the idea of a move towards more sensible pricing. Do you think it would be difficult to unlock so I can use my Orange account with it, or does that sort of thing take a little while to achieve or wait for? I've still got a lot of time on my contract for which I have a pretty good deal.

I think the price I mentioned is for a contract price. With no contract I read it will be nearer 200 squid.

John,

If you have a contract with them then if they try to retract, I'd say something like the below:

"As we have entered into a contract for the provision of x and you are now stating that you will not provide x, i will take that as your default under the contract and will be making a small claims court application for the losses that I am suffereing in respect of the additional £5 per month that you are attempting to charge, totalling £120 and other ancilliary losses including my time in dealing with the matter."

Would need to see the contract you entered into to be able to quote clauses etc but if you have entered a contract then it is binding on both parties and it is not your fault that they have mis-sold the product and service and offered you something at a lower price.

Personally find phone companies to be a royal pain in the backside and they act illegally on a regular basis and really do think they are above the law. O2 are still chasing me for the £350 that they think I owe them under a contract which they terminated 30 months ago when they moved me back to the correct type of contract that I had. Although it took 3 years to get them to transfer me off the consumer contract and back to the business style contract that I should have had due to their change from one software package to another.
